Lyndung Sdn. Bhd (“Lyndung”) acknowledged our responsibilities in relation to protecting the personal data that are in our possession and within our control. The collection of your personal data, uses and disclosure throughout this Programme by this Privacy Notice is protected under the Personal Data Protection Act 2010.

During signing up into the Lyndung Community Sharing Programme (“the Programme”), you are required to provide us with your personal data. In doing so, you are fully understand and consent Lyndung to use, transfer, collect and process it in accordance with this Privacy Notice.

Personal data refers to any information relating to identified or identifiable individuals from the data in Lyndung possession. The personal data collected may include but is not limited to your name, gender, address, NRIC number, telephone number and email address ("Personal Data"). Personal Data may also include sensitive information such as your medical history, physical and mental health status.

The Personal Data we required in order to provide you with our services is entirely voluntary. However, failure to provide the required data will negatively affect your participation in the Programme or any other programme offered by Lyndung.

How We Collect Your Data

Lyndung has obtained your data in various ways, such as:

1. When you voluntarily share such information directly or indirectly by key in the information or verbally during signing up or any other event to Lyndung;
2. When you communicate with Lyndung or any of its representatives or affiliates or other Program participants i.e. whenever you send us an inquiry;
3. When we acquire your medical history and/or report and health status from your existing medical doctor.
4. When you respond to our request for additional information and/or replying to your enquiry(ies);
5. When you access Lyndung's mobile apps and perform any online transaction;
6. When you respond to and are contacted by our telemarketers.

How Your Data May Be Used

Your personal data may be used for the following reasons;

1. To process your application to participate in the Programme;
2. To give you access to the content of the website or apps;
3. For administrative purposes;
4. To communicate with you i.e. to respond to your enquiry(ies);
5. To process your claims and payments for medical services;
6. To manage and maintain your account and the Programme's accounts;
7. To carry out any transaction pertaining with the Programme;
8. To provide the regulatory and the government bodies with the information in order to comply with legal and government regulations;
9. For Lyndung to comply with its obligations under the law of Malaysia;
10. To disclose your Personal Data i.e. your sensitive personal data, including your name, a camouflaged IC with only the first eight digits visible, the date of admission and discharge, the amount of bill submitted for community sharing, and a simple description of your illness when you are admitted under the Programme to the members of the Lyndung Community Sharing Programme; and
11. Other reasons were disclosed at the time of collection and directly associated with Lyndung.

Disclosure of Data

Lyndung will not purposely disclose your Personal Data. However, please note that Lyndung may share your personal information with the following parties exclusively on a need-to-know basis inside or outside Malaysia without obtaining your prior consent except for the purposes outlined below:

1. Disclosure of Personal Data for the purposes mentioned above;
2. Disclosure of Personal Data to affiliates a third party service providers such as Email Hosting and Online Marketing. Any third party service providers obligated to treat your Personal Data in accordance with the Privacy Notice.
3. Disclosure of Personal Data in connection with the re-organisation or re-structuring of the Programme which includes Lyndung's affiliates such as joint ventures and partnerships.
4. Disclosure of Personal Data to unaffiliated third parties is in crucial circumstances of which Lyndung needs to protect its rights, interests, property, and privacy, employees and affiliates.
5. Disclosure of Personal Data where required by law or when mandated by regulators.
6. Disclosure of Personal Data to any of our employees and affiliates on a news-to-know basis or the consent you hereby fully grant to avoid any doubt.

Disclosure of Rights

Lyndung reserves the right at any time without notice to amend, update or modify this Privacy Notice. Amendments made will be simply notified by stating the "Last updated on" date at the front page. This is to ensure that the Privacy Notice is in line with the future developments of Lyndung, the industry trends and/or any changes in regulatory requirements. Any such changes, updates or modifications will be effective immediately upon posting. Lyndung encourages you to review this Privacy Notice periodically.

Access & Correction Requests and Inquiries

Lyndung is committed to ensuring your personal information's accuracy, completeness, non-misleadingness and validity. Thus, you may request access to amend or correct your Personal Data at any time in the future, subject to any restrictions imposed by applicable legislation.
